1. About This SMS Program

These SMS Terms & Conditions ("SMS Terms") govern your participation in the text messaging program ("SMS Program") operated by FYNQ Medical Billing LLC ("FYNQ Medical Billing," "FYNQ," "we," "us," or "our"). Our SMS Program is delivered through our telecommunications providers, Twilio and Phone.com.

By providing your mobile phone number to us and opting in to receive SMS messages, you agree to these SMS Terms, our Privacy Policy, and our Terms of Service.

2. Program Description

The SMS Program is designed to communicate with prospective and current clients of FYNQ Medical Billing LLC regarding our medical billing and revenue cycle management services. Messages are business communications with practice representatives and do not contain patient protected health information (PHI). Through the SMS Program, you may receive messages such as:

• Replies to your inquiries about medical billing and revenue cycle services
• Quote, proposal, and pricing follow-ups
• Appointment confirmations and reminders
• Demo scheduling and confirmations
• Onboarding and account setup updates
• Training and support notifications
• Service, support, and account-related communications
• Promotional offers, service announcements, and marketing content (only if you have opted in to marketing messages)
• Customer satisfaction surveys

3. How to Opt In (Subscribe)

You can opt in to receive SMS messages from us in any of the following ways:

• Submitting your mobile phone number through a lead form, contact form, demo request form, or onboarding form on our website fynqmedicalbilling.com
• Checking an opt-in box that authorizes SMS communications when providing your phone number
• Verbally consenting during a phone conversation with a FYNQ Medical Billing LLC representative
• Texting us first at the phone number we provide
• Replying START or YES to a message from us, or to any other approved opt-in keyword

By opting in, you confirm that:

• You are at least 18 years of age
• You are the account holder of, or have authorization to use, the mobile phone number you provided
• You consent to receive recurring SMS messages from FYNQ Medical Billing LLC at the number provided
• You understand that consent is not a condition of any purchase of goods or services

4. Message Frequency

Message frequency varies based on your interactions with us. You may receive recurring messages, and frequency depends on the stage of your inquiry, account status, support needs, and your engagement with our marketing communications.

On average, you may receive between 2 and 10 messages per month, though this number may be higher or lower depending on the nature of your communications with us.

5. Message and Data Rates

Message and data rates may apply. Standard message and data rates from your wireless carrier may apply to each text message sent or received. The exact charges depend on your wireless plan. FYNQ Medical Billing LLC is not responsible for any charges from your wireless carrier resulting from your participation in the SMS Program.

If you have questions about your wireless plan, please contact your wireless carrier directly.

6. How to Opt Out (Unsubscribe)

You can opt out of receiving SMS messages from us at any time by:

• Replying STOP to any message we send you
• Replying END, CANCEL, UNSUBSCRIBE, or QUIT to any message

After you reply STOP, we will send you one final confirmation message acknowledging your opt-out, and you will not receive further SMS messages from us at that number unless you opt back in.

If you change your mind, you can opt back in at any time by replying START or UNSTOP, by texting us, or by contacting us directly.

If you need assistance, want more information about the SMS Program, or have questions about a message you received, you can:

8. Privacy and No Sharing for Marketing

We do not share your mobile phone number, SMS opt-in information, or text message content with any third parties or affiliates for their marketing or promotional purposes.

The only sharing of your mobile information is with subcontractors and service providers — such as Twilio, Phone.com, and other communications and IT vendors — that help us operate and deliver the SMS Program on our behalf. These providers are contractually required to maintain the confidentiality of your information and use it only to provide services to us.

9. Supported Carriers

Our SMS Program is available on most major U.S. wireless carriers, including but not limited to:

• AT&T
• Verizon Wireless
• T-Mobile
• Sprint
• U.S. Cellular
• Boost Mobile
• MetroPCS
• Cricket Wireless
• Virgin Mobile
• Google Fi

Carriers are not liable for delayed or undelivered messages. Your carrier's standard messaging and data rates apply. Service availability and message delivery may depend on your carrier's network coverage and capabilities.

10. Eligibility

You must be at least 18 years of age and a resident of the United States to participate in the SMS Program. By providing your mobile number and opting in, you represent and warrant that you meet these eligibility requirements.

11. Phone Number Changes

If you change or deactivate the mobile phone number you provided to us, you agree to promptly notify us by emailing [email protected] or calling (307) 776-6600. This helps prevent SMS messages from being delivered to a phone number that has been reassigned to someone who has not opted in to our SMS Program.

If you fail to notify us of a change, you agree that any messages we send to your previously provided number will be deemed properly delivered.

12. Disclaimers

The SMS Program is provided on an "as is" and "as available" basis. We do not guarantee that messages will be delivered or received at any specific time, that all messages will be error-free, or that the SMS Program will be uninterrupted, secure, or free from technical issues.

To the fullest extent permitted by law, FYNQ Medical Billing LLC is not responsible for:

• Delayed, undelivered, or incomplete messages caused by your carrier, mobile device, or network conditions
• Charges from your wireless carrier related to your participation in the SMS Program
• Any errors or inaccuracies in messages caused by you (such as providing an incorrect phone number)
• Any unauthorized access to your mobile device or wireless account

13. Limitation of Liability

To the fullest extent permitted by applicable law, FYNQ Medical Billing LLC, its affiliates, officers, directors, employees, agents, and SMS service providers shall not be liable for any direct, indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or in connection with your participation in the SMS Program, even if we have been advised of the possibility of such damages. The complete limitation of liability is set forth in our Terms of Service.

14. Changes to These SMS Terms

We may modify these SMS Terms or the SMS Program at any time, with or without notice. Material changes will be posted on our website at fynqmedicalbilling.com, and the "Last Updated" date at the top of this page will be updated. Your continued participation in the SMS Program after any changes constitutes your acceptance of the revised SMS Terms.

We reserve the right to terminate or suspend the SMS Program at any time without notice.

15. Governing Law and Jurisdiction

These SMS Terms shall be governed by the laws of the State of Wyoming, without regard to its conflict of law principles. Any disputes arising out of or relating to these SMS Terms shall be brought exclusively in the courts located in Sheridan County, Sheridan, Wyoming, or, where federal jurisdiction applies, in the United States District Court for the District of Wyoming, as more fully described in our Terms of Service.
